On 18 April 2007, the Arbitration Panel rejected the applications for restitution of the estates in tail-male in Lower and Upper Austria, a castle in Salzburg as well as fixtures and a picture gallery. According to the Arbitration Panel the first applicant, an association, cannot be regarded as a legal successor to the expired estates in tail-male. The applications of all applicants had to be rejected due to the lack of legitimacy since the second applicant and the third applicant did not dispose of hereditary titles.
The applications, which had to be decided, referred to the estate in tail male, which was founded in 1669 in Upper Austria and then sold to the German Reich in 1938. In 1956, the last tail male owner filed an application for restitution which was rejected by the Financial Directorate for Upper Austria since the registered owner of the properties (Reich district Oberdonau and town community Steyr) were neither identical to the German Reich nor to any of its institutions.

The German Reich had pronounced interest regarding the estates in tail male which were founded in 1706 in Lower Austria and which were located near the future military training area Döllersheim. Finally the entire estate in tail male had to be sold to the German Wehrmacht even though only one part was actually located within the confines of the planned military training area Döllersheim. In 1956, the last tail male owner filed an application for restitution. However, in 1961 his legal successors withdrew the application.

In 1943, the castle in Salzburg, which also had been applied for, was sold to the German Reich. In 1949, Germany sold the castle to a private owner who remains so until today. A part of the belonging real estate was never sold and still today is under the ownership of the family of the second applicant and of the third applicant.

The Arbitration Panel had to examine whether an estate in tail male represents an association as defined in Sec. 27 para. 2 of the General Settlement Fund Law and whether the first applicant, an association, can be regarded as a legal successor to the dissolved estate in tail male. Under “associations” are understood exclusively groups of persons who are linked through a common purpose. An estate in tail male is a property bound to a family on account of an order of the founder. Since, for this reason estates in tail male exclusively represent an earmarked property unit they do not fall under the definition of an association as defined in the General Settlement Fund Law. Since the dissolved estate in tail male does not represent a dissolved association the organization cannot be regarded to be its legal successor. Only the last estate in tail male owner respectively his legal successor could be regarded as being entitled to file applications. The second applicant and the third applicant cannot be considered to be heirs. Since the applicants cannot be considered to be legal successors the applications for restitution had to be rejected.
