Upper Austria, Lower Austria, Salzburg
On 30 September 2011, the Arbitration Panel for In Rem Restitution rejected an application for restitution of two entailed estates in Upper and Lower Austria and of a castle in Salzburg as the applicant was not an entitled heir to the entailed estates and the castle in Salzburg was privately-owned on the cut off day.

The requested entailed estate in Upper Austria was sold to the German Reich in 1938; the estate in Lower Austria in 1940. The restitution proceedings initiated by the last owner of the two entails were concluded in 1961 with a settlement between his legal successor and the Republic of Austria and the Province of Upper Austria respectively.

The castle in Salzburg, which was also requested, was sold to the German Reich in 1943. In 1949 the German Reich sold it to a private religious order which is still the owner today. One part of the properties belonging to the castle was never sold and is still owned by the applicant’s family.

As the applicant was not an eligible heir of the last owner of the entailed estates, the application in this regard had to be rejected. The application for restitution of the castle in Salzburg was rejected because it was not publicly-owned on the cut off day 17 January 2001.
