Upper Austria, Lower Austria, Salzburg
On 7 November 2001, the Arbitration Panel for In Rem Restitution rejected an application for restitution of properties belonging to two former entailed estates in Upper and Lower Austria, as the applicant was not a legitimate heir to these estates. The application for restitution of a castle and two properties in Salzburg and a property in Salzburg-Aigen was also rejected as the properties were not publicly-owned on the cut off day 17 January 2001.

In 1938, the requested entailed estate in Upper Austria was sold to the German Reich; the entailed estate in Lower Austria was sold to the German Reich in 1940. The restitution proceedings initiated in 1956 by the last owner of both entailed estates ended in 1961 with a settlement concluded between his legal successor and the Republic of Austria and the Province of Lower Austria respectively. As the applicant was not a legitimate heir to the last owner of the entailed estates, the application in this regard had to be rejected.

The requested castle in Salzburg was sold to the German Reich in 1943, which sold it on to a private congregation which remains the owner today. As the castle was therefore not publicly-owned on the cut off day 17 January 2001, the application in this regard was also rejected.

The requested properties in Salzburg-Stadt and Salzburg-Aigen were not owned by the family of the applicant during the National Socialist era and were also not publicly-owned on the cut off day 17 January 2001. The application in this regard was therefore also rejected.
