Upper Austria, Lower Austria, Salzburg

On 7 November 2011, the Arbitration Panel for In Rem Restitution rejected applications for the reopening of the proceedings regarding the restitution of entailed estates in Lower and Upper Austria, a castle in Salzburg, furnishings and a portrait gallery. The applicants neither submitted new statements nor presented any new evidence.

The Arbitration Panel had already dismissed the applications for restitution of two entailed estates in Lower and Upper Austria, a castle in Salzburg, furnishings and a portrait gallery in its decision no 366/2007 of 18 April 2007.

In the previous proceedings, the first applicant, an association, was not considered to be the legal successor to the expired entails. The other applicants were not eligible heirs and their applications were therefore dismissed as they were not eligible to file applications. The requested castle in Salzburg was not publicly-owned on the cut off day 17 January 2001. The applications in this regard were also dismissed for this reason.

The second and third applicant in the proceedings leading to decision no. 366/2007 submitted new applications for the same object as the applications on which the Arbitration Panel had ruled in decision no. 366/2007.

The renewed applications were not classified as applications for the reopening of proceedings by the Arbitration Panel. They were rejected because the applicants had neither submitted new statements nor produced new evidence.
